I got one for my birthday this year and it works perfectly. And yes it does have batteries, the energy has to be stored somewhere. And yes eventually the batteries will not recharge. But if you use it as an emergency flashlight you should be fine

Isn't the battery a rechargeable? Seems to me that they are just made way to cheaply so that the parts are highly susceptible to malfunction. If used strictly as an Emergency Tool, they should fair fine. Put it in a drawer and Don't play with it. Even years from now it will probably work just fine and is a great device that is well worth $20! I bought 5 of some at [] for $250 each. I have 2 perfect ones left after 1 year. 1 I keep in a drawer and 2 I keep under the seat in my car. That one I use all the time and it works awesome. What a wonderfull age of technology we live in.
